    Rule 553-2-.03. Exemption from Residential Contracting Examination - Qualifying Agent Holding a Residential Contracting License from a Georgia Political Subdivision

    To prove that an applicant who is applying for licensure as a qualifying agent for a business organization incorporated in Georgia or otherwise authorized and certified to transact business in Georgia holds a current and valid license to engage in residential contracting issued to him or her by any governing authority of any political subdivision of this state, the applicant must cause to be submitted to the division a verification of licensure verifying such from that political subdivision. The verification of licensure will be on a form included with the application for examination exemption. Additionally, the verification of licensure shall show that the applicant passed an examination required by the governing authority, which examination is substantially similar to the state examination for residential contractors, in order for the applicant to obtain the license from that governing authority. The division shall determine whether the examination[s] required by such governing authority of the political subdivisions in Georgia is substantially similar to the state examination for residential contractors. Additionally, the applicant must show that said corporation or business organization possesses a regular office and place of business in Georgia currently and that said corporation or business organization has had the office and place of business continuously for the five years immediately preceding the time of application by swearing to the veracity of such on the application for examination exemption.

    §21–304.

    (a) An applicant who otherwise qualifies for a registration is entitled to be examined as provided in this section.

    (b) The Board shall give examinations to applicants at least twice a year, at the times and places that the Board determines.

    (c) The Board shall give each qualified applicant notice of the time and place of examination.

    (d) The Board shall give the examination prepared by the Internal Revenue Service or an equivalent examination by an independent national or state regulatory authority as determined by the Board.

    (e) The Board shall adopt regulations that establish the passing score for an examination.

    (f) (1) The Board shall notify each applicant of the applicant’s examination score.

    (2) Any applicant who requests an appointment within 60 days after the date on which notification is sent may review the applicant’s answers to the examination.

    §4–506.1.

    (a) The Board may reinstate a barbershop permit that has expired if the owner of the barbershop:

    (1) applies to the Board for reinstatement within 45 days after the permit expires;

    (2) otherwise meets the requirements of § 4–506(c) of this subtitle; and

    (3) pays to the Board a reinstatement fee established by the Board in accordance with § 4–206 of this title, in addition to the renewal fee required under § 4–506(c)(2) of this subtitle.

    (b) If an owner of a barbershop has failed to renew a barbershop permit and applies to the Board for reinstatement more than 45 days after the permit has expired, the Board shall reinstate the permit only if the barbershop owner qualifies for a barbershop permit in accordance with §§ 4–502 and 4–503 of this subtitle.

    (a) A real estate broker or a designee of the real estate broker may designate two members of a team as intracompany agents for the seller and the buyer in the same transaction if the parties have first been advised in writing that the licensees are part of the same team and the team could have a financial interest in the outcome of the transaction.

    (b) If a broker’s designee designates intracompany agents under subsection (a) of this section, the broker’s designee may not be a member of the real estate team.

    §464-5  Limitation upon application of chapter.  Nothing in this chapter shall prevent any person from engaging in engineering, architectural, or landscape architectural work and undertakings upon property owned or exclusively controlled or possessed by that person, or from hiring any person to do the work and undertakings, unless the work and undertakings involve the safety or health of the public, nor shall anything in this chapter prevent any person from engaging in land surveying upon property owned or exclusively controlled or possessed by that person or from hiring any person to do the work, unless the work involves a common boundary.

    Nothing in this chapter shall be construed as applying to the business conducted in this State by any agriculturist, horticulturist, tree expert, arborist, forester, gardenshop operator, nursery operator or landscape nursery operator, gardener, landscape gardener, landscape contractor, landscape designer, landscape consultant, garden or lawn caretaker, or cultivator of land, as these terms are generally used, except that no person shall use the designation "landscape architect", "landscape architectural", or "landscape architecture" unless licensed under the provisions of this chapter.

    All engineering work, architectural work, and landscape architectural work in which the public safety or health is involved shall be designed by and the construction observed by a duly licensed professional engineer, architect, or landscape architect, respectively.   • HRS §444-7 Classification

    §444-7  Classification.  (a)  For the purpose of classification, the contracting business includes any or all of the following branches:

    (1)  General engineering contracting;

    (2)  General building contracting;

    (3)  Specialty contracting.

    (b)  A general engineering contractor is a contractor whose principal contracting business is in connection with fixed works requiring specialized engineering knowledge and skill, including the following divisions or subjects:  irrigation, drainage, water power, water supply, flood control, inland waterways, harbors, docks and wharves, shipyards and ports, dams and hydroelectric projects, levees, river control and reclamation works, railroads, highways, streets and roads, tunnels, airports and airways, sewers and sewage disposal plants and systems, waste reduction plants, bridges, overpasses, underpasses and other similar works, pipelines and other systems for the transmission of petroleum and other liquid or gaseous substances, parks, playgrounds and other recreational works, refineries, chemical plants and similar industrial plants requiring specialized engineering knowledge and skill, powerhouses, power plants and other utility plants and installations, mines and metallurgical plants, land levelling and earth-moving projects, excavating, grading, trenching, paving and surfacing work and cement and concrete works in connection with the above mentioned fixed works.

    (c)  A general building contractor is a contractor whose principal contracting business is in connection with any structure built, being built, or to be built, for the support, shelter, and enclosure of persons, animals, chattels, or movable property of any kind, requiring in its construction the use of more than two unrelated building trades or crafts, or to do or superintend the whole or any part thereof.

    (d)  A specialty contractor is a contractor whose operations as such are the performance of construction work requiring special skill such as, but not limited to, electrical, drywall, painting and decorating, landscaping, flooring, carpet laying by any installation method, plumbing, or roofing work, and others whose principal contracting business involves the use of specialized building trades or crafts.
